FlightPrep Steps Up Enforcement of Online Flight Planning Patent


Developers of websites and software that provide flight planning and filing must tread lightly now. In late 2009, EFB manufacturer and aviation software developer Stenbock and Everson, Inc. (dba FlighPrep) won U.S. Patent No. 7,640,098 for online flight planning. The patent was invented by FlightPrep founders Roger Stenbock and Kyle Everson, and cites the ability for a user to download and display charts over the Internet from a remote server, and to modify flight plans without pulling the charts from the server again. The patent also covers the ability to file flight plans over the Internet. In an open letter to the aviation community released in December 2010, Flight Prep founders Everson and Stenbok state: "We filled for a patent in 2001 with the United States Patent and Trademark Office (USPTO). As any inventor who has ever gone through this process knows, this is a very difficult and lengthy process without any guarantee of success. Fortunately, after a rigorous examination and considerable effort and expense, the USPTO issued a patent in 2009 for the process of generating travel plans on the Internet, what we all call online flight planning." FlightPrep’s patent request was denied, revised and resubmitted several times between 2001 and 2009, until it was finally approved in December of 2009. Over the same period, numerous Internet-based flight planning services popped up with competing products, but now that the patent has been awarded, these competitors may face some legal problems if they cannot work out suitable agreements with FlightPrep. “It is not our intent to create a monopoly, put others out of business, or prevent others from participating in the aviation community,” stated Stenbock and Everson in the December 2010 letter.
